Welcome to Bling On®. These Terms & Conditions (“Terms” or “Terms of Use”) govern your access to and use of the Bling On® website, online store, related webpages, facilities and services made available through blingon.co.in (collectively, the “Platform”).

References in these Terms to “Bling On®”, “Platform Owner”, “we”, “us” or “our” refer to ANJU BALA carrying on business under the Bling On® brand.

These Terms constitute an electronic record under applicable Indian law, including the Information Technology Act, 2000 and applicable rules and amendments.

By accessing, browsing, registering with, placing an order through, purchasing from or otherwise using the Platform, you acknowledge that you have read, understood and agreed to be bound by these Terms.

If you do not agree with these Terms, you must not use the Platform or purchase products through it.

By using the Platform, you represent that you are legally competent to enter into a binding contract under applicable Indian law.

Your use of the Platform may also be governed by our Privacy Policy, Shipping Policy, Cancellation Policy, Return & Refund Policy and other policies displayed on the Platform. Such policies are incorporated into these Terms by reference where applicable.

Bling On® offers jewellery, accessories, handmade products, resin jewellery, polymer clay jewellery, real-flower jewellery, personalized products, gifting products and other merchandise introduced from time to time.

Many Bling On® products are handmade, individually crafted or individually finished. Consequently, reasonable differences may occur between individual pieces.

Variations in colour, texture, flower placement, pattern, dimensions, surface characteristics, transparency, pigmentation, inclusions or other handmade characteristics are not necessarily manufacturing defects.

Products incorporating natural flowers, petals, leaves or botanical materials may naturally differ because no two natural specimens are completely identical.

We make reasonable efforts to display product descriptions, photographs, colours, dimensions, materials and other information accurately.

However, colours and appearance may vary depending upon photography, lighting, editing, screen calibration, display technology, browser, device settings and other technical factors.

Product photographs may contain styling props, decorative materials, displays, packaging or accessories. Unless specifically stated in the applicable product description as being included, such items should not be assumed to form part of the purchased product.

Reasonable differences between a handmade product and its representative photograph shall not automatically constitute a manufacturing defect or misrepresentation.

Nothing in this section limits any statutory consumer rights that cannot lawfully be excluded.

Product prices displayed on the Platform are generally stated in Indian Rupees (INR) unless otherwise indicated.

Prices, discounts, promotions and product availability may change from time to time, subject to applicable law.

Taxes, delivery charges and other applicable charges will be disclosed where required and/or calculated during checkout.

If an obviously incorrect price is displayed because of a typographical, technical, software or system error, we reserve the right, subject to applicable law, to correct the error.

Where a material pricing error is discovered before fulfilment, we may contact the customer regarding the error or cancel the affected order. Where a prepaid order is lawfully cancelled, the applicable amount received will be refunded.

Submission of an order constitutes an offer by the customer to purchase the selected product or products subject to these Terms.

Receipt of an automated order confirmation does not necessarily constitute final acceptance where additional payment, fraud, inventory or order verification is reasonably required.

Subject to applicable law, we may refuse or cancel an order for legitimate reasons including:

• Payment failure or unsuccessful payment authorization;
• Product or stock unavailability;
• Suspected fraudulent or unauthorized transactions;
• Incorrect pricing caused by a genuine technical error;
• Materially incorrect product information caused by a system error;
• Incomplete or undeliverable shipping information;
• Violation or suspected abuse of these Terms;
• Misuse of discounts, coupons or promotional benefits;
• Security concerns;
• Suspected unauthorized commercial resale; or
• Circumstances beyond our reasonable control.

Where we cancel an eligible prepaid order, amounts due to the customer will be refunded in accordance with applicable law and our published policies.

Customers must provide complete and accurate billing and payment information.

Payments may be processed through independent payment gateways, banks, UPI providers, card networks or other authorized payment service providers.

Bling On® does not control the independent technical systems of banks and third-party payment providers.

Payment will ordinarily be treated as successfully received after confirmation is received from the applicable payment processor.

Where an amount is debited but an order is not successfully generated or confirmed, reconciliation or reversal may depend upon the relevant bank/payment provider and its applicable processing timelines.

Bling On® may undertake reasonable verification measures to protect customers and the business from fraud, unauthorized transactions, chargeback abuse and misuse of the Platform.

For suspicious, unusual or high-value transactions, we may request reasonable additional confirmation before dispatch where permitted by applicable law.

Transactions reasonably identified as fraudulent, unauthorized, abusive or unlawful may be refused or cancelled subject to applicable law.

Orders are shipped in accordance with the Shipping Policy published on the Platform.

Unless expressly guaranteed, delivery dates and delivery periods displayed on the Platform are estimates.

Delivery may be affected by courier operations, weather conditions, natural disasters, transportation interruptions, strikes, governmental restrictions, incorrect addresses, customer unavailability or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address, PIN code, telephone number and other information reasonably necessary to deliver the order.

Where legally permissible, additional shipping or re-delivery costs arising solely from incorrect or incomplete information supplied by the customer may be charged to the customer.

Customers should inspect delivered packages promptly.

If a package appears visibly damaged, tampered with or materially compromised, the customer should preserve the packaging, shipping label and relevant evidence and contact us promptly in accordance with our applicable return/refund policy.

We may reasonably request photographs, videos, packaging information, courier labels or other supporting evidence necessary to investigate a claim relating to damaged, defective, missing or incorrect goods.

Evidence requirements will not be applied in a manner that unlawfully deprives a customer of mandatory statutory rights.

Returns, replacements, cancellations and refunds are governed by the Return & Refund Policy and Cancellation Policy displayed on the Platform together with applicable Indian law.

Products eligible for return should ordinarily be returned in the condition and with the accessories, packaging, labels and documentation specified in the applicable return policy, subject to mandatory consumer rights.

Products created, engraved, manufactured, preserved, designed or personalized according to customer specifications may be subject to special cancellation and return conditions, subject to applicable law.

Customers are responsible for checking names, spellings, dates, photographs, dimensions, colours, messages and other customization information before submitting or approving an order.

Where we manufacture a product accurately according to information supplied or approved by the customer, an error originating solely from customer-provided information will not ordinarily constitute a manufacturing defect.

This does not affect remedies available for goods that are defective, damaged, incorrectly manufactured or materially misrepresented.

Handmade jewellery is not produced with the absolute uniformity associated with industrial mass manufacturing.

For resin products, reasonable variations may arise from curing, pigments, inclusions, botanical placement and hand-finishing.

For polymer clay products, slight differences may occur in colour, texture, pattern, shape and hand-finishing.

For real-flower products, variations may arise from the natural shape, size, colour, age and structure of botanical material.

Such normal handmade and natural characteristics should not be regarded as defects merely because one item is not visually identical to another or to a representative photograph.

Customers are responsible for following reasonable jewellery care instructions supplied with products or displayed on the Platform.

Depending upon the product, exposure to water, perfumes, cosmetics, chemicals, excessive heat, prolonged direct sunlight, moisture, impact, bending, scratching or improper storage may cause deterioration or damage.

Normal wear and tear, accidental damage, misuse, improper handling or damage caused by failure to follow reasonable care instructions is not necessarily a manufacturing defect.

Customers with known skin sensitivities, metal allergies or sensitivities to particular materials should review available product information before purchasing.

Where the exact material composition is important because of a known allergy or sensitivity, customers should contact us for clarification before placing an order.

Nothing in this section excludes liability that cannot lawfully be excluded.

Where customer accounts are available, users are responsible for maintaining the confidentiality of their login credentials and for activity attributable to their use of the account.

Customers must provide accurate, current and complete information and should promptly notify us if they reasonably believe their account has been accessed without authorization.

Users must not knowingly use the Platform to:

• Gain unauthorized access to our systems or accounts;
• Introduce malware, viruses or malicious code;
• Interfere with Platform security or functionality;
• Conduct fraudulent transactions;
• Use stolen or unauthorized payment credentials;
• Impersonate another person or business;
• Abuse coupons, discounts, referrals or promotions;
• Infringe intellectual property rights;
• Systematically scrape Platform data without authorization where prohibited;
• Engage in unlawful commercial exploitation of Platform content; or
• Use the Platform for any purpose prohibited by applicable law.

We may reasonably restrict or terminate access where necessary to protect the Platform, customers, security or our legitimate business interests, subject to applicable law.

Unless otherwise stated, the Platform and its original content, including trademarks, trade names, logos, product photographs, product designs, graphics, illustrations, written content, videos, layouts and branding are owned by or lawfully licensed to Bling On®.

The Bling On® name, identity and associated branding must not be used in a manner that falsely suggests affiliation, authorization or endorsement.

Platform content must not be reproduced, commercially exploited, republished, systematically copied or distributed without authorization except where permitted by applicable law.

Original jewellery designs, photographs, artwork, artistic presentations, packaging concepts and other protectable creative works may be protected under applicable intellectual property laws.

Purchase of a Bling On® product does not transfer intellectual property rights in the product design, branding, photography or associated creative content.

Where customers submit reviews, photographs, comments or other content, they represent that they have the necessary rights to submit that material.

Users must not knowingly submit fake, defamatory, unlawful, infringing, abusive or materially misleading content.

Subject to applicable law and permissions obtained at submission, customer-submitted content may be displayed in connection with the Platform and Bling On® marketing.

Discount codes, promotional offers, vouchers, campaigns and special prices may be subject to separate eligibility requirements, validity periods and conditions.

Unless expressly stated otherwise, promotional benefits may not be combined.

We may reject fraudulent, duplicated, manipulated or unauthorized use of promotional benefits, subject to applicable law.

The Platform may integrate with or link to independent services including payment gateways, courier providers, social networks and other third-party websites.

Such third parties may operate under their own terms, policies and privacy practices.

A link or technical integration does not automatically constitute an endorsement of all third-party content, services or practices.

We aim to maintain reliable Platform availability but cannot guarantee uninterrupted or completely error-free operation.

Access may be temporarily restricted because of maintenance, security updates, technical failures, infrastructure changes or circumstances outside our reasonable control.

To the maximum extent permitted by applicable law, the Platform and its content are provided on an “as available” basis.

We do not guarantee that the Platform will always be uninterrupted, completely error-free or free from every technical vulnerability.

Nothing in these Terms excludes warranties, guarantees, remedies or statutory rights that cannot legally be excluded.

To the maximum extent permitted by applicable law, Bling On® shall not be liable for indirect, incidental, special or consequential losses arising from use of the Platform where such liability may lawfully be excluded.

Any contractual limitation of liability contained in these Terms operates only to the extent permitted by applicable law.

Nothing in these Terms is intended to exclude or restrict liability where exclusion or restriction is prohibited by law, including mandatory consumer-protection or product-liability requirements.

To the extent permitted by applicable law, users agree to indemnify and hold harmless Bling On®, its owner, representatives and personnel from third-party claims, losses and reasonable costs arising directly from the user's unlawful conduct, material breach of these Terms, infringement of third-party rights or fraudulent misuse of the Platform.

This provision does not require a consumer to indemnify Bling On® for our own unlawful conduct or breach of mandatory legal obligations.

To the extent permitted by law, Bling On® shall not be responsible for delay or failure in performance caused by circumstances beyond our reasonable control.

Such circumstances may include natural disasters, floods, fires, epidemics, pandemics, war, civil disturbances, governmental restrictions, transportation interruptions, courier disruptions, strikes, telecommunications failures or comparable events.

This provision remains subject to rights and remedies that cannot legally be excluded.

Personal information collected through the Platform will be processed in accordance with our Privacy Policy and applicable data-protection law.

Customers should review the Privacy Policy for information about categories of personal data collected, purposes of processing, disclosures, retention practices and applicable rights.

Where applicable, transactions conducted through the Platform are subject to relevant Indian consumer-protection and e-commerce requirements.

Bling On® will not rely upon these Terms to enforce a contractual provision that is prohibited or unenforceable under mandatory consumer law.

Transactional communications relating to orders, payments, shipping, refunds, account security and customer service may be provided electronically where permitted by law.

Marketing communications will be handled in accordance with applicable legal requirements and available consent or opt-out mechanisms.

We may suspend or terminate access to the Platform where reasonably necessary because of fraud, unlawful activity, security threats, material violation of these Terms or misuse of our systems.

Termination shall not extinguish rights or obligations that accrued before termination.

If any provision of these Terms is determined by a competent authority to be invalid, unlawful or unenforceable, that provision shall be enforced to the maximum lawful extent or severed as appropriate.

The remaining provisions shall continue in effect to the extent legally permissible.

Failure or delay by Bling On® in exercising a contractual right shall not automatically constitute a waiver of that right.

We may amend these Terms from time to time to reflect changes in our business, Platform, policies, products, services or applicable law.

The latest version will be published on the Platform with an updated revision date.

Material changes will apply prospectively to the extent required by applicable law.

These Terms shall be governed by and construed in accordance with the laws of India.

Subject to applicable mandatory consumer-protection laws and any jurisdiction that cannot legally be excluded by agreement, disputes relating to these Terms or transactions through the Platform shall be subject to the jurisdiction of competent courts at Jamshedpur, Jharkhand, India.

Nothing in this provision prevents a consumer from exercising any forum or jurisdictional right mandatorily available under applicable law.

Questions, complaints or communications concerning an order, product, payment, delivery, refund, Platform usage or these Terms may be submitted through the contact facilities provided by Bling On®.

Where applicable law requires publication of designated grievance officer particulars or specific grievance-handling timelines, applicable information should be displayed on the Platform.

These Terms, together with the Privacy Policy, Shipping Policy, Cancellation Policy, Return & Refund Policy and other policies expressly incorporated by reference, constitute the agreement governing use of the Platform and relevant transactions, subject always to applicable law.
